Zapewne wiesz droga czytelniczko/drogi czytelniku, że od rat alimentacyjnych płatnych miesięcznie należne są odsetki za opóźnienie.
Odsetki za opóźnienie od alimentów
Wysokość odsetek za opóźnienie reguluje kodeks cywilny – obecnie (tj. na 24 października 2019 roku) 7 % w skali roku /ich wysokość wynosi sumę stopy referencyjnej NBP i 5,5 procent/.
Odsetki za opóźnienie należą się w przypadku….. no właśnie opóźnienia, tj. zawinionego lub niezawinionego niedochowania terminu płatności.
Termin płatności alimentów
W Polsce z reguły alimenty są ustalane do płacenia na dzień 10-ty każdego miesiąca, a zatem od dnia następnego może powstać opóźnienie.
Pobyt w areszcie a wymagalność alimentów
Pewien rodzic miał wątpliwość i poprosił mnie o wyjaśnienie. Otóż chciał wiedzieć czy w razie jego pobytu w zakładzie karnym w celu odbywania kary pozbawienia wolności (orzeczonej za niealimentayję) alimenty lub chociażby płatność odsetek za opóźnienie ulega zawieszeniu.
WYJAŚNIAM: Pobyt w areszcie lub zakładzie karnym nie zwalnia zobowiązanego rodzica od obowiązku płatności alimentów w terminie ustalonym w wyroku lub ugodzie sądowej. Odsetki za opóźnienie również się należą.

Jestem bezsilna. Mąż siedzi od 24.03 a nawet nie miał przedstawionego wyroku sądu. Nie wiem czy jest skazany czy tymczasowo zatrzymany. On sam też nic nie wie bo mu nikt nic nie mówi.
Plus jak ma płacić alimenty skoro siedzi i nie może pracować, przez co nie może zarabiać żeby płacić…
Dodam że komornik zabiera mu 1518zl z wypłaty, zostaje mu 900zl a alimentów płacić musi 1000zl i jak on ma płacic i jeszcze jakoś żyć. Do tego utrzymać rodzinę….
