Zbrodnia , czyli poważne przestępstwo zagrożone karą od 3 lat pozbawienia wolności.
Pokrzywdzony , czyli osoba, która na skutek czyjegoś zachowania będącego zbrodnią odniosła krzywdę.
Przestępca, osoba popełniającą zbrodnię.
Kara , czyli sprawiedliwa odpłata za zbrodnię.
CZY JEST ZBRODNIA BEZ KARY i rola obrońcy.
Wbrew utartym schematom i przekonaniom, rola adwokata nie sprowadza się do pomocy w uniknięciu kary za zbrodnię popełnioną przez przestępcę.
W ramach wymiaru sprawiedliwości funkcjonuje kilka ról procesowych – jest oskarżyciel (prokurator), jest obrońca (adwokat) i jest sąd (sędzia).
Zadaniem oskarżyciela jest doprowadzić do skazania przestępcy i zapewnienia ochrony pokrzywdzonemu;
Natomiast obrońca ma zapewnić, by sprawca zbrodni nie poniósł surowszej kary niż powinien;
Zadaniem sądu jest wyważyć żądania oskarżyciela i obrońcy, tak by wydać sprawiedliwy wyrok.
Nie ma zbrodni bez kary.
